Terms of Service

Welcome to Menulync.com (“Menulync,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of Menulync’s Point of Sale (POS) software, website, mobile applications, and related services (collectively, the “Services”).

By creating an account, subscribing, or otherwise using our Services, you (“Customer,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Definitions

  • “Services”: Menulync’s restaurant POS software, mobile apps, integrations, and related offerings.

  • “Customer Data”: All information, menu items, transactions, and other data entered or processed through the Services by you.

  • “Subscription Plan”: The selected paid plan that governs your access to certain features of the Services.

  • “Payment Processor”: Third-party providers that process payments made through Menulync.

 

2. Eligibility

  • You must be at least 18 years old or the legal age of majority in your jurisdiction to use Menulync.

  • By using Menulync, you represent that you are a restaurant, food service operator, or authorized agent with the authority to enter into these Terms.

3. Accounts and Registration

  • To access the Services, you must create an account with accurate business and contact details.

  • You are responsible for maintaining account security, including safeguarding login credentials.

  • You are liable for all activity conducted under your account.

4. Use of Services

You may use Menulync’s Services only for legitimate restaurant and business purposes. You agree not to:

  • Use the Services for unlawful, fraudulent, or unauthorized transactions.

  • Tamper with, disrupt, or misuse the software or hardware provided by Menulync.

  • Circumvent any security or usage restrictions built into the Services.

5. Customer Data

  • You retain ownership of all Customer Data processed through the Services.

  • By using the Services, you grant Menulync a non-exclusive license to host, process, and use Customer Data solely to provide and improve the Services.

  • You are solely responsible for the accuracy, legality, and security of your Customer Data.

6. Payment Processing

  • Menulync may integrate with third-party Payment Processors to handle customer transactions.

  • By using payment features, you agree to comply with the terms and policies of the Payment Processor.

  • Menulync is not responsible for disputes, chargebacks, or delays caused by third-party Payment Processors.

7. Subscription Fees and Billing

  • Access to certain features requires a paid Subscription Plan.

  • You authorize Menulync or its payment providers to charge your selected payment method for applicable fees.

  • Subscription fees are billed in advance and are generally non-refundable, except as required by law or explicitly stated in our Refund Policy.

  • Failure to pay may result in suspension or termination of Services.

8. Hardware and Third-Party Services

  • Menulync may recommend or provide compatible POS hardware. Any third-party hardware is governed by the vendor’s warranty and policies.

  • Menulync is not responsible for failures or issues related to third-party hardware, internet services, or payment providers.

9. Intellectual Property

  • Menulync and its licensors own all rights, titles, and interests in the software, trademarks, logos, and content associated with the Services.

  • You may not copy, modify, reverse engineer, or resell the Services without prior written consent.

10. Termination and Suspension

  • Menulync may suspend or terminate your access to the Services if you:

    • Fail to pay fees,

    • Violate these Terms, or

    • Engage in harmful or fraudulent activities.

  • Upon termination, your right to use the Services ceases immediately, and we may delete your Customer Data in accordance with our data retention policies.

11. Disclaimers

  • The Services are provided on an “AS IS” and “AS AVAILABLE” basis.

  • Menulync does not guarantee uninterrupted or error-free operation of the Services.

  • Menulync is not responsible for losses resulting from technical issues, internet outages, or third-party providers.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Menulync shall not be liable for any indirect, incidental, consequential, or punitive damages, including lost revenue, profits, or data.

  • Menulync’s total liability in any claim relating to the Services shall not exceed the total fees paid by you to Menulync in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Menulync, its affiliates, employees, and partners from any claims, damages, or expenses arising from:

  • Your use of the Services;

  • Your violation of these Terms; or

  • Any third-party claims related to your Customer Data or business operations.

14. Governing Law and Dispute Resolution

  • These Terms shall be governed by and construed under the laws of KSA.

  • Any disputes shall be resolved exclusively in the courts located in KSA.

15. Changes to Terms

We may update these Terms from time to time. Updated versions will be posted on this page with the new “Last Updated” date. Your continued use of the Services constitutes acceptance of the updated Terms.
